1. Introduction
These Terms and Conditions (“Terms”) govern access to and use of the Kelvuri platform (“Platform”, “Services”). By accessing or using the Platform, the user agrees to these Terms in full. If the user does not agree, the Platform must not be used.
Kelvuri is a platform supporting nursing students, graduates, and professionals with interview preparation, exam readiness, skill development, assessments, coaching, career progression, and future job assistance and placement services.
Use of the Platform is also governed by Kelvuri’s Privacy Policy and, where applicable, the Refund Policy, each of which forms part of these Terms.
These Terms are governed by the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.
2. Eligibility and Accounts
Users must meet the minimum age required under applicable law to use the Platform.
By creating an account, the user agrees to:
- Provide accurate and complete information
- Keep account credentials secure
- Accept responsibility for all activity conducted under the account
Institution-sponsored users may be subject to additional rules set by their institution and to separate agreements between Kelvuri and the sponsoring institution. Where such an agreement exists, its terms govern the sponsored user’s access in addition to these Terms.
Kelvuri may suspend or restrict accounts in the event of misuse or violation of these Terms.
3. Nature of Services
Kelvuri provides tools and content for:
- Exam preparation, including entrance, licensing, and job-related examinations
- Skill development and assessments
- Interview preparation
- Career guidance and progression support
Future services may include job discovery, employer connections, and international career and placement opportunities. As such services are introduced, these Terms and the Privacy Policy will continue to apply, and users will be notified of any material additions.
4. Educational Purpose
The Platform is intended for educational and training purposes only. Platform content does not constitute professional clinical judgment, formal education, medical advice, or regulatory guidance. Users are responsible for exercising independent judgment when applying any knowledge or information obtained through the Platform.
5. License to Use the Platform
Kelvuri grants each user a limited, personal, non-exclusive, non-transferable licence to access and use the Platform for educational and career development purposes only.
The user may not:
- Copy, distribute, or reproduce Platform content without Kelvuri’s written permission
- Reverse-engineer or attempt to extract source systems, algorithms, or databases
- Commercially exploit any part of the Platform
6. User Conduct
The user agrees not to:
- Provide false or misleading information
- Attempt unauthorised access to Platform systems or data
- Disrupt Platform functionality
- Use the Platform to facilitate cheating in examinations or to misrepresent qualifications
- Deploy bots, scraping tools, or automated systems without Kelvuri’s prior written permission
Kelvuri may take action including suspension or termination of access in the event of violations.
7. Content, AI and Intellectual Property
All Platform content, including quizzes, explanations, coaching materials, and assessments, is owned by or licensed to Kelvuri. Portions of Platform content, including questions, explanations, and assessments, may be generated or assisted by automated systems, including AI-based tools. Kelvuri reviews and updates content on an ongoing basis but does not guarantee that content is always accurate, complete, or current.
Users retain ownership of content they upload, including resumes and application materials. By uploading such content, the user grants Kelvuri a limited licence to use it for the purpose of providing the Services.
8. Assessments, Scores and Ratings
Kelvuri may provide performance insights including scores, rankings, and skill evaluations. Such insights are indicative and intended for self-evaluation and learning purposes only. They may not reflect real-world examination results, clinical performance, or employer evaluation standards and must not be treated as definitive measures of ability.
Users are responsible for how they interpret and act upon assessment results.
9. Job and Placement Services
Kelvuri may, in the future, offer features to support job discovery, applications, employer connections, and international career placement. Kelvuri does not guarantee job offers, interview success, or placement outcomes. Any engagement between a user and an employer or placement partner is independent of Kelvuri.
10. Third-Party Services
The Platform may integrate with or link to third-party providers, including payment processors, analytics services, and employers. Kelvuri is not responsible for the actions, decisions, content, or policies of such third parties. Users are encouraged to review the privacy and terms of any third-party service they engage with through the Platform.
11. Payments and Fees
Certain Platform features require payment. Payments are processed through third-party payment providers. Pricing and access conditions may change over time. Fees paid for Platform access are non-refundable except as expressly provided in Kelvuri’s Refund Policy or as required by applicable law.
Access under institutional or sponsored arrangements is governed by separate agreements between Kelvuri and the relevant institution, and the Refund Policy does not apply to such accounts.
12. System Availability and Errors
Kelvuri aims to provide a reliable Platform. However, services may be subject to interruption, delay, or unavailability. Errors, bugs, or inaccuracies may occur. Kelvuri may monitor, identify, and address technical issues as part of its ongoing improvement process. Users are encouraged to report issues through the support channel.
13. Disclaimers
The Platform and Services are provided on an “as is” and “as available” basis. Kelvuri does not warrant:
- Continuous or error-free operation of the Platform
- The accuracy, completeness, or currency of Platform content
- Outcomes including examination success, skill improvement, or employment placement
14. Limitation of Liability
To the extent permitted by applicable law, Kelvuri is not liable for:
- Decisions made by users in reliance on Platform content
- Loss of data, opportunities, income, or other outcomes
- Indirect, incidental, or consequential damages of any kind
Where liability cannot be excluded by law, Kelvuri’s total liability is limited to the amount paid by the user to Kelvuri in the twelve months preceding the relevant claim.
15. Indemnification
The user agrees to indemnify and hold Kelvuri, its officers, employees, and licensors harmless from any claims, losses, or expenses (including legal fees) arising from the user’s use of the Platform, violation of these Terms, or infringement of any third-party rights.
16. User Responsibility
Users are solely responsible for how they use the Platform and for how they apply information or assessments obtained through it. Kelvuri does not accept responsibility for outcomes arising from a user’s reliance on Platform content.
17. Feedback and Improvements
Users may report inaccuracies, errors, or concerns to Kelvuri. Any feedback submitted may be used by Kelvuri to improve the Platform and Services without obligation or compensation to the user.
18. Termination
Users may cease use of the Platform at any time. Kelvuri may suspend or terminate a user’s access where these Terms have been violated or where misuse is detected. Provisions relating to intellectual property, disclaimers, limitation of liability, and indemnification survive termination.
19. Amendments to These Terms
Kelvuri reserves the right to amend these Terms at any time. Amendments will take effect upon publication on this page, accompanied by an updated effective date. Continued use of the Platform following publication of an amendment constitutes acceptance of the amended Terms. For matters arising from use prior to an amendment, the version of these Terms in force at the relevant date shall apply.
20. Miscellaneous
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between the user and Kelvuri in respect of the Platform and supersede all prior agreements or representations.
